A bipartisan Senate report on the January 6 insurrection came out last night, and it’s highly critical of the Capitol Police, but it doesn’t address Trump’s role in encouraging the riot.
A new Senate report reveals previously unknown details about the stunning security breakdowns ahead of the January 6 US Capitol attack, including a finding that the US Capitol Police’s main intelligence unit “was aware of the potential for violence” beforehand.
The report adds an authoritative emphasis to previous evidence that there were massive intelligence failures, critical miscommunications, and unheeded warnings that ultimately led to the chaotic response that day.
Among the failures was an inability by intelligence officials to tie together a swirl of troubling internet chatter leading up to the riot and a reliance on using past, non-violent Trump rallies in security planning.
There are also several glaring omissions in the report including any examination of Donald Trump’s role in the riots, raising questions about whether lawmakers, in their quest for bipartisanship, exposed the limits of a Congress divided and unable to agree on certain truths, particularly those related to the former President’s actions.
Sources tell CNN that in order for this report, which was compiled by the Senate Homeland Security and Rules committees, to have support from both parties, the language had to be carefully crafted, and that included excluding the word “insurrection,” which notably does not appear outside of witness quotes and footnotes.
Clearly we need an independent commission to investigate the origins of the violent attack on the U.S. Capitol. Nevertheless the Senate report does reveal new information.

Recommendations for the future?
The report’s recommendations, which call for better planning, training and intelligence gathering, largely mirror those of other investigators who have examined the topic, and its contents steer clear of offering any assessment or conclusion about Trump’s responsibility for the riot.
Still, the report provides a vivid picture of how poor communication and unheeded warnings left officers underequipped to face violent threats about which they had not been made aware, leaving the Capitol vulnerable to an attack that otherwise might have been preventable.
According to the report, Capitol Police intelligence officers knew as early as Dec. 21 that protesters planned to “bring guns” and other weapons to the Jan. 6 demonstration and turn them on any law enforcement officers who blocked their entry into the Capitol. They knew that would-be rioters were sharing maps of the Capitol campus online and discussing the building’s best entry points — and how to seal them off to trap lawmakers inside. But that information was shared only with command officers.
A separate security assessment dated Dec. 23 made no mention of those findings. Neither did a follow-up Dec. 30.

The New York Times: ‘Does Anybody Have a Plan?’ Senate Report Details Jan. 6 Security Failures.
Top federal intelligence agencies failed to adequately warn law enforcement officials before the Jan. 6 riot that pro-Trump extremists were threatening violence, including plans to “storm the Capitol,” infiltrate its tunnel system and “bring guns,” according to a new report by two Senate committees that outlines large-scale failures that contributed to the deadly assault.
An F.B.I. memo on Jan. 5 warning of people traveling to Washington for “war” at the Capitol never made its way to top law enforcement officials. The Capitol Police failed to widely circulate information from its intelligence unit that supporters of President Donald J. Trump were posting online about pressuring lawmakers to overturn his election loss.
“If they don’t show up, we enter the Capitol as the Third Continental Congress and certify the Trump Electors,” one post said.
“Bring guns. It’s now or never,” said another.
The first congressional report on the Capitol riot is the most comprehensive and detailed account to date of the dozens of intelligence failures, miscommunications and security lapses that led to what the bipartisan team of senators that assembled it concluded was an “unprecedented attack” on American democracy and the most significant assault on the Capitol in more than 200 years….
The 127-page joint report, a product of more than three months of hearings and interviews and reviews of thousands of pages of documents, presents a damning portrait of the preparations and response at multiple levels. Law enforcement officials did not take seriously threats of violence, it found, and a dysfunctional police force at the Capitol lacked the capacity to respond effectively when those threats materialized.

U.S. Capitol Police leaders learned that Trump supporters were discussing ways to infiltrate tunnels around the complex and target Democratic members of Congress on Jan. 6 but failed to act on the threats, according to a new Senate report summing up what it says were profound intelligence and security failures that contributed to one of the worst incidents of domestic terrorism in U.S. history.

The report also says that officers complained about a lack of leadership within the department as they tried to repel the attack — and that top leaders were virtually silent as they begged for help.
Through tips from the public and other sources, Capitol Police “knew about social media posts calling for violence at the Capitol on January 6, including a plot to breach the Capitol, the online sharing of maps of the Capitol Complex’s tunnel systems, and other specific threats of violence,” the report said, but the police force’s intelligence division “did not convey the full scope of known information to USCP leadership, rank-and-file officers, or law enforcement partners.”
The Capitol Police’s possession of the specific intelligence had been previously flagged by the department’s inspector general in a report that has not made public, NBC News and other news organizations have reported. But the Senate document sheds new light on it. The failure to distribute the information widely, the report says, left rank-and-file Capitol Police officers unprepared to defend themselves from the armed mob.
“The objects thrown at us varied in size, shape and consistency,” an officer said. “Some were frozen cans and bottles, rebar from the construction, bricks, liquids, pepper spray, bear spray, sticks of various widths, pipes, bats.”
Another officer told Senate investigators: “We were ill prepared. We were NOT informed with intelligence. We were betrayed.”

Never-before-heard audio, obtained exclusively by CNN, shows how former President Donald Trump’s longtime adviser Rudy Giuliani relentlessly pressured and coaxed the Ukrainian government in 2019 to investigate baseless conspiracies about then-candidate Joe Biden.
The audio is of a July 2019 phone call between Giuliani, US diplomat Kurt Volker, and Andriy Yermak, a senior adviser to Ukrainian President Volodymyr Zelensky. The call was a precursor to Trump’s infamous call with Zelensky, and both conversations later became a central part of Trump’s first impeachment, where he was accused of soliciting Ukrainian help for his campaign.
During the roughly 40-minute call, Giuliani repeatedly told Yermak that Zelensky should publicly announce investigations into possible corruption by Biden in Ukraine, and into claims that Ukraine meddled in the 2016 election to hurt Trump. (These separate claims are both untrue.)
“All we need from the President [Zelensky] is to say, I’m gonna put an honest prosecutor in charge, he’s gonna investigate and dig up the evidence, that presently exists and is there any other evidence about involvement of the 2016 election, and then the Biden thing has to be run out,” Giuliani said, according to the audio. “… Somebody in Ukraine’s gotta take that seriously.”
The new audio demonstrates how Giuliani aggressively cajoled the Ukrainians to do Trump’s bidding. And it undermines Trump’s oft-repeated assertion that “there was no quid pro quo” where Zelensky could secure US government support if he did political favors for Trump.
The call was one of the opening salvos in the years-long quest by Trump and his allies to damage Biden and subvert the 2020 election process — by soliciting foreign meddling, lying about voter fraud, attempting to overturn the results, and inciting the deadly January 6 assault on the Capitol.
I hadn’t heard of this crazy conspiracy theory until yesterday. Vanity Fair: Trump’s Deranged Theory That Democrats Would Replace Biden Might Have Helped Him Lose 2020.
In early 2020, a frustrated and furious Donald Trump described Joe Biden as “a mental retard” while struggling to cope with his own placement in early polls, according to a passage from “Frankly, We Did Win This Election”: The Inside Story of How Trump Lost, a forthcoming book by senior Wall Street Journal reporter Michael Bender. The author notes that Trump vented his anger at the time by interrupting “a policy meeting in the Oval Office to ask, ‘How am I losing in the polls to a mental retard?’”
In another moment Bender writes that Trump held back on focusing his firepower on Biden during the primary stage of the election because he was convinced that the Democratic Party was scheming to switch out now president Biden for a different candidate—such as Hillary Clinton or Michelle Obama—over the summer. The source of this conspiracy theory, per Bender, was Dick Morris, a former Clinton White House adviser who was “quietly advising Trump” last year. “Dick Morris told Trump that Biden was too old and too prone to gaffes to be the nominee,” Bender writes, while others in Trumpworld felt Biden would exit the race and be replaced by someone else if Trump began bashing him too hard. “Others said Fox News anchor Sean Hannity expressed concern that Biden would collapse under a sustained attack from Trump.”
According to Bender, Trump also felt that his attack strategy had backfired during the first stage of the Democratic primary. “The president, meanwhile, had often complained that his early attack on [Elizabeth] Warren had damaged her presidential bid, which he regretted because he viewed her as an easier opponent than Biden,” Bender writes. “Now he worried that a heavy blitz of attack ads would hasten the secret plot being hatched by Democrats, and his mind raced with who they might select in Biden’s place.” During a meeting held the month after the coronavirus outbreak hit the U.S., Trump expressed his Biden replacement theory to advisers, saying that Democratic leadership would “realize [Biden is] old, and they’re going to give it to somebody else. They’re going to give it to Hillary, or they’re going to give it to Michelle Obama.”
One person in Trump’s circle did work to put a stop to this absurd belief, which Trump apparently clung to so deeply that he “had cited it as a reason to hold off on heavy spending against Biden earlier in the month.” Bender writes that Trump campaign pollster Tony Fabrizio “devoted nearly an entire page of [a campaign memo] to debunking a conspiracy theory that had bubbled up inside Trump World, including with the president, that Democrats were going to steal Biden’s nomination at the convention.” In the memo, Fabrizio reportedly wrote, “I know there is some concern (which I strenuously disagree with) that if we go after Biden too soon, we can collapse him, and the Dems will replace him at their convention. I know POTUS tends to share this opinion.” Bender adds: “The pollster aimed to debunk the theory by outlining the remaining Democratic primaries, in which Biden had no significant challenger, and the delegate math to secure the nomination. Biden would have enough delegates to secure the nomination in just three weeks, Fabrizio explained, and it would be mathematically impossible to steal it in four weeks.”

Yesterday Joe Biden commemorated Memorial Day with a speech honoring those who served the country in wartime, while cautioning that “democracy…is in peril.”

President Joe Biden marked Memorial Day with an address at Arlington National Cemetery, pledging to never forget or fail to honor fallen veterans’ sacrifice and saying that democracy is “worth fighting for” and “dying for.”
Democracy, which he called the “soul of America,” is in danger, Biden said on Monday.
“Democracy itself is in peril, here at home and around the world,” Biden said, speaking to military officials and people who have lost military loved ones after a wreath-laying ceremony at the Tomb of the Unknown Soldier. “What we do now, what we do now, how we honor the memory of the fallen, will determine whether or not democracy will long endure.”
Throughout the speech Monday, Biden praised veterans’ sacrifice for democracy and defended democracy’s aspirations, though he said the U.S. hadn’t always lived up to them. He called empathy “the fuel of democracy.”
The president said that “we all” take democracy “for granted,” saying “the biggest question” is whether the system of democracy can win out over opposing “powerful forces.”
“All that we do in our common life as a nation is part of that struggle,” Biden said. “A struggle for democracy. It’s taking place around the world, democracy and autocracy.”
Democracy is in danger because the Trumpist Republican Party opposes it. Since their cult leader lost the 2020 election, Republicans are focused on making voting more difficult. The latest effort took place in Texas. Fortunately, Democrats in the Texas legislature were able to fend off the new Jim Crow law for now.

In a dramatic surprise, Texas Democrats stopped the GOP’s latest and lowest voter suppression effort at the eleventh hour (literally – the session was adjourned at 11pm Monday night). They used tricks, stunts, and gambits. They chased the headlines, and grabbed them. Democrats, this is how you do it.
For months, these outrageous, baseless, anti-democratic, and cravenly self-interested Republican efforts in state after state have been the “sleeper story” of the year. In some ways, Republican voter suppression isn’t new; they’ve been lying about voter fraud for years, even though it has never existed on a widespread level. And some of the concrete measures are familiar: closing voting locations in predominantly Black areas (yes, it really is that brazen), restricting early and absentee voting, and so on….
So far, Democrats have failed to stop this racist and anti-democratic freight train. It’s barreled through Florida, Georgia, and Iowa. It’s rigged the 2022 elections by making it harder for Black voters (and voters who can’t get off of work easily, or need help getting to the polls) to vote. It’s a national disgrace.
But it’s barely made the news….
These efforts should be headline freaking news. The blatantly racist nature of these policies. Their likely effects on the next election. And their foundation in the same conspiracy theory that led to the January 6 insurrection in Washington, D.C. All of these are beyond outrageous, but journalists can’t just make news happen; that’s up to politicians and other public figures who give us something to report.
Which is exactly what Texas Democrats did Sunday night.
They raised every possible technical and procedural objection to the vote. They indulged in long-winded Q&A sessions. They stretched the process out for hours. And then, right before eleven at night on the eve of Memorial Day, they walked out, depriving the Texas State House of Representatives of a quorum.
Even the walkout was dramatic. Texas State Representative Chris Turner texted party members at 10:35, writing, “Members, take your key and leave the chamber discreetly. Do not go to the gallery. Leave the building. ~ Chris”
Gotta love it.
But the bill could still pass. What’s needed is national legislation to protect voting rights.

On Tuesday, I wrote about the sudden mainstreaming of the so-called “lab leak theory” of the origins of Covid-19 in China. Today David Leonhardt has an “explainer” of this sudden attention to this long-dismissed notion.
Suddenly, talk of the Wuhan lab-leak theory seems to be everywhere.
President Biden yesterday called on U.S. intelligence officials to “redouble their efforts” to determine the origin of Covid-19 and figure out whether the virus that causes it accidentally leaked from a Chinese laboratory. Major publications and social media have recently been filled with discussion of the subject.
The origin of the virus remains unclear. Many scientists have long believed that the most likely explanation is that it jumped from an animal to a person, possibly at a food market in Wuhan, China, in late 2019. Animal-to human transmission — known as zoonotic spillover — is a common origin story for viruses, including Ebola and some bird flus.But some scientists have pointed to another possibility: that it escaped from the Wuhan Institute of Virology. As in other laboratories, researchers there sometimes modify viruses, to understand and treat them.
“It is most likely that this is a virus that arose naturally, but we cannot exclude the possibility of some kind of a lab accident,” Dr. Francis Collins, the director of the National Institutes of Health, told senators yesterday.
Leonhardt writes–as I did on Tuesday–that the reason this is suddenly getting so much attention is because a number of scientists have recently argued that the lab leak theory should be investigated.
Among the reasons: Chinese officials have refused to allow an independent investigation into the lab and have failed to explain some inconsistencies in the animal-to-human hypothesis. Most of the first confirmed cases had no evident link to the food market.
But has anything really changed?
In some ways, not much has not changed. From the beginning, the virus’s origin has been unclear. All along, some scientists, politicians and journalists have argued that the lab-leak theory deserves consideration.
Almost 15 months ago, two Chinese researchers wrote a paper concluding that the virus “probably originated from a laboratory in Wuhan.” Alina Chan, a molecular biologist affiliated with Harvard and M.I.T., made similar arguments. David Ignatius and Josh Rogin, both Washington Post columnists, wrote about the possibility more than a year ago. Joe Biden, then a presidential candidate, didn’t mention the lab-leak theory in early 2020 but he did argue that the U.S. should “not be taking China’s word” for how the outbreak started.
But these voices were in the minority. The World Health Organization initially dismissed the lab-leak theory as implausible.

If you read the comments on the Tuesday post, you know that Quixote, who is quite knowledgeable on this subject, vehemently argued against the lab leak theory. Quixote posted another comment yesterday that I didn’t see until this morning:
The virus isn’t engineered because you can tell by the RNA sequence. If it had been, the inserted bits will be obvious when you compare it to related viruses. Sort of like Frankenstein’s monster is visibly sewn together from parts that don’t go together.
The early cases don’t particularly center on the lab or on people associated with it. They’re outside Wuhan, inside Wuhan, at the abandoned mine / bat cave, at the captured animal food market, and so on. The pattern is what you’d see if a virus mutated to be able to infect people, but wasn’t very good at it yet, and had been moving through the population for a while. In the course of simmering through the population, the most successful virus would be the one that changed enough to infect people easily.
It had enough time to do that, and that was exactly the threat the Wuhan lab, and also CDC people there, were looking for. (Trump, by the way, cut funding for both of those because what the hell do we need to be paying people in China for.) The danger was noticed by Chinese doctors (one of whom soon died of the disease) who tried hard to alert the world. They were squelched by the government. If the CDC people had still been there, it would have been a lot harder to squelch.
So tl:dr; no evidence covid19 was an intentional bioweapon thing. Poor evidence that it could have unintentionally leaked. It’s a fact that the attempted coverup by the Chinese let the pandemic get going. If procedures at the lab need improving, they certainly should be.
The other things you mention about China are all true. (Tibet too. Never forget Tibet.) It’s been obvious for decades that China was going to abuse whatever power it could get. But that’s another whole train of thought.
As bad as they are, covid19 does not fit the lab leak story at all well. Both things can be true: they’re bad and covid was an incompetent accident made infinitely worse by self-serving dictators all over the world, including China.
I agree that there certainly is no evidence for the lab leak theory. The only reason I thought there could be something to it was that several people in the lab got sick with something that looked like Covid-19 and were hospitalized. I thought they could have gotten the virus from the cave samples–not that the virus was engineered in the lab–and that somehow the virus got into the population that way. But there is no way to ever know if this happened, as China would never cooperate with any investigation.
Now that Biden has ordered an investigation, we will likely hear more about this, but I can’t see how we’re ever going to know for sure how the virus originated. The crossover from animal to human explanation makes the most sense.

In other Covid-19 news, The New York Times reports that two studies have found that Immunity to the Coronavirus May Persist for Years.
Immunity to the coronavirus lasts at least a year, possibly a lifetime, improving over time especially after vaccination, according to two new studies. The findings may help put to rest lingering fears that protection against the virus will be short-lived.

Together, the studies suggest that most people who have recovered from Covid-19 and who were later immunized will not need boosters. Vaccinated people who were never infected most likely will need the shots, however, as will a minority who were infected but did not produce a robust immune response.
Both reports looked at people who had been exposed to the coronavirus about a year earlier. Cells that retain a memory of the virus persist in the bone marrow and may churn out antibodies whenever needed, according to one of the studies, published on Monday in the journal Nature.
The other study, posted online at BioRxiv, a site for biology research, found that these so-called memory B cells continue to mature and strengthen for at least 12 months after the initial infection.
“The papers are consistent with the growing body of literature that suggests that immunity elicited by infection and vaccination for SARS-CoV-2 appears to be long-lived,” said Scott Hensley, an immunologist at the University of Pennsylvania who was not involved in the research.

It’s also not new that the perpetrator had a history of violence against women. Fox News: San Jose shooting leaves 9 dead, deceased suspect identified; victims shot in separate buildings.
The eight people initially killed by a gunman at a Northern California rail yard Wednesday morning were shot in two separate buildings before the suspected shooter took his own life, authorities said Wednesday.
A ninth victim died in a hospital late Wednesday evening, authorities said.

Santa Clara Sheriff Laurie Smith expressed her grief for the families of the victims before praising the quick response of law enforcement officers who went into a Valley Transportation Authority building as the active shooting was happening. She said deputies and San Jose police officers were the first on the scene.
The suspect was identified Wednesday as Samuel Cassidy, 57, who was a VTA employee, officials said. No motive is known for the shooting at this time.
An ex-girlfriend told the San Francisco Chronicle he was prone to alcohol-fueled mood swings and had been accused in a March 2009 court filing of rape and abuse. The documents were filed in response to a domestic violence restraining order that Cassidy had filed earlier that month.
The former girlfriend alleged his mood swings worsened when he drank alcohol and that he played “several mind games which he seems to enjoy.” She listed several incidents of alleged sexual assault in which he would hold her arms and force his weight onto her.
He would apologize and promised to never do it again afterward, the report said.

The man who opened fire Wednesday at a rail yard in San Jose, killing nine other people and ending his own life, has been identified as 57-year-old Sam Cassidy. He was an employee of the Valley Transportation Authority, which provides bus, light rail and other transit services throughout Santa Clara County, authorities said.
Cassidy was identified as a maintenance worker at the Valley Transportation Authority….
According to The Associated Press, Cassidy had talked to his ex-wife about killing people at work more than a decade ago.
“I never believed him, and it never happened. Until now,” a tearful Cecilia Nelms told The Associated Press.
She said he used to come home from work resentful and angry over what he perceived as unfair assignments.
“He could dwell on things,” she said. The two were married for about 10 years until a 2005 divorce filing and she hadn’t been in touch with Cassidy for about 13 years, Nelms said.
I’m still perplexed and fascinated by the Q-Anon phenomenon. There a couple of stories about it today.
NBC News: Study finds nearly one-in-five Americans believe QAnon conspiracy theories.
Washington, we have a problem — politically, informationally and societally — when 15 percent of Americans agree with the QAnon statement that the U.S. government, media and financial worlds “are controlled by a group of Satan-worshipping pedophiles who run a global child sex trafficking operation.”
Or when 20 percent agree with this statement: “There is a storm coming soon that will sweep away the elites in power and restore the rightful leaders.”
Or when another 15 percent agree that “Because things have gotten so far off track, true American patriots may have to resort to violence in order to save our country.”
These are the results of a PRRI-IFYC study that was conducted online March 8-30, but that was just released Thursday.
And the study finds that Republicans, those who trust far-right news outlets like OANN and Newsmax, and white evangelicals and Hispanic Protestants are all more likely to believe these statements than other Americans.
It’s hard to call something fringe when approximately one-in-five Americans believe these statements, especially one that true patriots “may have to resort to violence” to save the country.

Three Components of the QAnon Conspiracy Movement
The far-right conspiracy theory movement known as QAnon emerged on the internet in late 2017 and gained traction throughout former president Donald Trump’s time in office. QAnon’s core theory revolves around Satan-worshipping pedophiles plotting against Trump and a coming “storm” that would clear out those evil forces, but the movement has also been described as a “big tent conspiracy theory” that involves a constantly evolving web of schemes about politicians, celebrities, bankers, and the media, as well as echoes of older movements within Christianity, such as Gnosticism.
To understand how this loosely connected belief system is influencing American politics, religion, and media, we fielded three questions, each containing a tenet of the QAnon conspiracy movement….
QAnon Beliefs and Partisanship
A nontrivial 15% of Americans agree with the sweeping QAnon allegation that “the government, media, and financial worlds in the U.S. are controlled by a group of Satan-worshipping pedophiles who run a global child sex trafficking operation,” while the vast majority of Americans (82%) disagree with this statement. Republicans (23%) are significantly more likely than independents (14%) and Democrats (8%) to agree that the government, media, and financial worlds in the U.S. are controlled by a group of Satan-worshipping pedophiles who run a global child sex trafficking operation.
Similarly, one in five Americans (20%) agree with the statement “There is a storm coming soon that will sweep away the elites in power and restore the rightful leaders,” while a majority (77%) disagree. Nearly three in ten Republicans (28%), compared to 18% of independents and 14% of Democrats, agree with this secondary QAnon conspiracy theory. Trends among demographic groups are similar to those of the core QAnon conspiracy theory.
Fifteen percent of Americans agree that “Because things have gotten so far off track, true American patriots may have to resort to violence in order to save our country,” while the vast majority (85%) disagree. Republicans (28%) are twice as likely as independents (13%) and four times as likely as Democrats (7%) to agree that because things have gotten so far off track, true American patriots may have to resort to violence.

It seems Republicans in the Beltway would rather not think about the Trumpist insurrection on January 6, 2021. We’ve been told it was just a typical tourist outing. We get told we should get beyond it and work on issues and stuff which basically means using Fox propaganda to talk down any policy but catering to crazy right-wing Christianists and white nationalists or tax-cutting for huge corporations and billionaires. We were also told it wasn’t Trumpists. All that adds up to telling us to not believe our lying eyes reinforced by repeated videos playing showing something quite different. Also, don’t believe the stories of Capitol Officers impaled on flagpoles bearing flags stating said impaler supports the police.
Why even the target of the lynch mob–then Vice President Mike Pence–couldn’t get respect from his brother yesterday. This is from Newsweek: “Greg Pence, Mike Pence’s Brother, Votes Against Jan. 6 Commission, Calls It ‘Cover-up for Failed Biden Admin’.” Yup, I don’t get that statement either.
The brother of former Vice President Mike Pence is defending his House vote against a commission to investigate the violent attack on the United State Capitol that forced his brother into a secured location, calling it a “cover-up for the failed Biden administration.”
“I was here with him, he never left his post,” U.S. Representative Greg Pence, a Republican from Indiana, told reporters at the Capitol on Thursday. “We impeached the president weeks, days later and now here we are having an investigation? Sounds a little bassackwards, right?”
The 1/6 Commission, modeled after the panel assigned to review the September 11, 2001 terrorist attacks, would review the lead-up to the attack, Capitol security, and future measures that should be taken to prevent another Capitol security issue.
Intelligence doesn’t seem to run in that family.
And so we’re still living the big lie in states targeted for illegal vote recounts. Arizona’s been the laughing stock of the country since the Cyber Ninjas arrived to destroy ballots and search for bamboo in ballots. The Cyber Ninjas are taking it to those states along with rallies by your favorite lie shouting fascist. And you thought he was only around fleecing the government for Secret Service shananigans still. States that he will not admit he lost will see the Disgraced Former Guy at rallies.
Meanwhile, the US Senate has taken up the call for a bi-partisan investigation into the January 6 insurrection. Here are two thought pieces on that.
Haley Byrd Wilt writing for Uphill at the Dispatch has this headline: “GOP Senators Dig In Against January 6 Commission, Many say they still haven’t read the legislation. But they have problems with it.”
Most Senate Republicans are opposed to the House’s proposed independent commission to look into the January 6 attack on the Capitol and the events leading up to it. They’re just not exactly sure why.
In interviews with more than 20 GOP senators on Thursday, Republicans raised fears about how the commission would work, how long it would last, and whether it would amount to a partisan circus. The answers to many of these questions are in the text of the relatively straightforward, 19-page bill passed by the House this week. When pressed on the gap between the details of the bill and their portrayal of it, some senators simply admitted they hadn’t read the legislation.
“If you’re going to turn a commission into a political partisan weapon, you know, use it to subpoena people to embarrass them, use it to want to make allegations that might prove useful in the 2022 elections, you’re actually contributing to the problem,” said Florida Sen. Marco Rubio—who initially expressed more openness to the commission in a conversation with The Dispatch on Monday night. “My general feeling is that if we can have a serious examination of the events leading up to, occurring, and in the aftermath of that day, we should do it,” Rubio said at the time, notably splitting with Republican leaders who called for the commission to also look into violence largely unrelated to January 6. He said Thursday he still hasn’t ruled out the possibility of supporting the commission, but he sounded a lot more skeptical.
“I’m worried about what it would do to our country to have a so-called independent commission that ultimately turns into a partisan political weapon that continues to exacerbate these tensions and divide people even more,” he said. “Because in a way, it sort of contributes to the very environment that made that day possible.”
Rubio’s concern that the commission will issue political subpoenas is addressed by the legislation: The commission would be evenly divided, with five members appointed by Democratic leaders and five appointed by Republican leaders. For Democrats to issue any subpoena, at least one of the five Republican members would have to agree to it. This was a key demand from GOP leaders—that their appointees would essentially have the power to veto subpoenas. That massive concession from Democrats hasn’t made much of an impression on Republican senators, though.
“Well, I’m still going through all the details of it,” Rubio said when The Dispatch pointed out how the commission would be structured and how subpoenas would be issued. “Honestly, we’ve got so much going on here. This is something the House just passed.”
“I haven’t even read it,” Rubio added. “I mean, it just came over. But just my overarching concern is I can already see the shadow of how this is going to be used for a political purpose, and I’m not interested in formalizing some partisan political weapon by either side.”
The bill text has been publicly available since last Friday. The two parties debated the contours of the commission for four months. It would take maybe a couple of minutes for a staffer to outline the important details for their boss—or just a few minutes longer for a lawmaker to actually read the legislation itself. There’s also, of course, a famous precedent that the bill can be compared with: The original September 11 commission legislation.

The filibuster has been on hiatus since Joe Biden took over. Senate Republicans are about to change that — over a bipartisan commission to probe the Capitol riot.
After more than four months of letting their power to obstruct lie unused in the Senate, the 50-member Senate GOP is ready to mount a filibuster of House-passed legislation creating an independent cross-aisle panel to investigate the Jan. 6 insurrection. If Republicans follow through and block the bill, they will spark a long-building fight over the filibuster’s very existence.
The filibuster has spent months of lurking in the background of the Senate’s daily business, but the battle over the chamber’s 60-vote threshold will erupt as soon as next week. Senate Majority Leader Chuck Schumer is plotting to bring the House’s Jan. 6 commission bill to the floor and daring Senate Republicans to block it.
And GOP opposition is hardening by the day. According to interviews with more than a half-dozen Republicans on Thursday, there is almost no path to even opening up debate on the bill — much less passing it.
“I don’t think there will be 10 votes on our side for it,” said Sen. Mike Braun (R-Ind). “At this stage, I’d be surprised if you’re gonna get even a handful.”
Senate Minority Leader Mitch McConnell has been circumspect about his use of the filibuster, leaving the tool untouched so far this Congress as his conference has advanced Democratic bills confronting hate crimes, planning water infrastructure and increasing American competitiveness. But the Jan. 6 commission — and talking about former President Donald Trump for months on end — is a bridge too far for the GOP.
So, an armed insurrection that threatened the lives of this new brand of mugwumps wasn’t a bridge too far for them. Say we had a 9/11 attack and nobody gave a damn enough to look into it?

I remind you I was considered an apostate republican in 1992 for supporting Roe V Wade, the Equal Rights Amendment, and marching through streets with lesbians celebrating women’s suffrage. They’ve been at this for decades.
I still can’t believe what they’ve put Hillary Clinton through for decades. Over 30 freaking Benghazi hearings that find nothing and we can’t get an investigation into folks trying to start a Civil War over a total lie?

New York Attorney General Letitia James is investigating former President Donald Trump’s business, the Trump Organization, “in a criminal capacity,” her office says, ratcheting up scrutiny of Trump’s real estate transactions and other dealings.
The state attorney general is joining forces with Manhattan District Attorney Cyrus Vance Jr., who has been conducting a separate criminal inquiry into Trump’s business practices and possible insurance or financial fraud as well as alleged hush money payments to two women who said they had affairs with Trump before he became president….

The new collaboration between the state and local offices is an unusual event in itself: In New York, the attorney general and the district attorney have historically been rivals. But in this case, they’re working together.
Two assistant attorneys general have now joined the district attorney’s team of prosecutors. They’re all trying to unravel troves of complicated information, including millions of pages of tax returns and other documents related to how the Trump Organization operates in the U.S. as well as its sprawling international enterprises.
With the shift in focus from James’ office, we now know that both of these prosecution teams are making a determined and coordinated effort to sift through evidence of possible crimes.

The New York Times: Top Trump Executive Under Criminal Investigation Over Taxes.
The New York attorney general’s office has been criminally investigating the chief financial officer of former President Donald J. Trump’s company for months over tax issues, according to people with knowledge of the matter.
The office of the attorney general, Letitia James, notified the Trump Organization in a January letter that it had opened a criminal investigation related to the chief financial officer, Allen Weisselberg, the people said. The investigators have examined whether taxes were paid on fringe benefits that Mr. Trump gave him, including cars and tens of thousands of dollars in private school tuition for at least one of Mr. Weisselberg’s grandchildren….

The focus on perks and Mr. Weisselberg overlaps with the Manhattan district attorney’s long-running criminal fraud investigation of Mr. Trump and his family business. The district attorney’s office has been investigating the extent to which Mr. Trump handed out fringe benefits to some of his executives, including Mr. Weisselberg, and whether taxes were paid on those perks, The New York Times previously reported.
In recent weeks, Ms. James’s office suggested to the company in a new letter that it had broadened the criminal investigation beyond the focus on Mr. Weisselberg, one of the people said. It was unclear how the inquiry had widened.
In general, fringe benefits — which can include cars, flights and club memberships — are taxable, though there are some exceptions. Companies are typically responsible for withholding such taxes from an employee’s paycheck….
In addition to the fringe benefits, Ms. James and the district attorney, Cyrus R. Vance Jr., have examined whether Mr. Trump’s company inflated the value of his properties to obtain favorable loans and lowered the values to reduce taxes.

The pressure on Weisselberg is mounting from two directions with the attorney general looking into his personal taxes, while prosecutors in the district attorney’s office are digging into his role at the Trump Organization, his personal finances, and benefits given to his son Barry, a long-time employee of the Trump Organization.
Prosecutors are seeking to find leverage that could sway Weisselberg into cooperating with authorities, people familiar with the investigation said, potentially raising the legal stakes for Trump and his family. It’s a common tactic used by prosecutors to try to get individuals to “flip” to help build a case higher up the corporate ladder. Vance’s office is coordinating with James’ office on its criminal investigation into Weisselberg….

The tax investigation into Weisselberg’s personal finances by New York attorney general Letitia James was opened several months ago and is being handled by a small unit within the office that has authority to bring criminal charges, people familiar with the investigation said.
Those investigators have been coordinating with prosecutors in the Manhattan district attorney’s office led by Cyrus Vance Jr, which has been investigating the Trump Organization, going through Trump’s tax returns, and recently has been examining perks the company gave to employees, Weisselberg’s finances, and benefits he and his son received, people familiar with the inquiry said.

James’ office announced late Tuesday that her long-running civil investigation into Trump’s alleged financial wrongdoing had evolved into a full-fledged criminal inquiry, but did not spell out when or why that significant upgrade was made.
Duncan Levin — an attorney for Jennifer Weisselberg, the estranged daughter-in-law of a top Trump Organization executive — shed some light on that omission Wednesday, telling the Daily News that his client has been cooperating in the criminal component of James’ investigation since March.
“We’ve been aware of the attorney general’s criminal investigation for several months now, since March, and have been in touch with prosecutors in the criminal division and have provided them with evidence,” Levin said….
James’ exact line of criminal inquiry is unclear, but the fact that she’s conducting it with [New York District Attorney] Vance’s help suggests it could also be focused on allegations of fraud. A source familiar with the matter told The News that two assistant attorneys general from James’ office have been specifically tapped to spearhead coordination with Vance….
Jennifer Weisselberg, whose estranged father-in-law is Allen Weisselberg, Trump’s longtime chief financial officer, has been asked by prosecutors from James’ criminal division about a Trump-owned Midtown apartment overlooking Central Park that she and her ex-husband lived in rent-free for years, Levin said.

Levin said his client has also provided James’ investigators with documents about her family’s finances.
Another key cooperator in both the James and Vance probes is former Trump attorney Michael Cohen, who has met with the DA’s team nearly a dozen times.
James’ criminal announcement, Cohen said Wednesday, shows “the troubles for Donald Trump just keep on coming.”
“Soon enough, Donald and associates will be held responsible for their actions,” Cohen said. “Now that you see the [Manhattan] district attorney and the attorney general’s offices working in concert, I do believe that indictments will be issued shortly, and definitely before summer’s end.”

Yesterday evening, New York State’s attorney general, Letitia James, announced, “We have informed the Trump Organization that … We are now actively investigating the Trump Organization in a criminal capacity.” According to The New York Times, James will be sending two of her office’s prosecutors to join the team of Cyrus Vance Jr., the Manhattan DA. With this news, Donald Trump, those around him, and the country as a whole inch closer to the prospect that a former president could face criminal charges, and possibly even prison time. The country has not been through anything like this before.
The ongoing investigation is sweeping. James began it as a civil investigation following the 2019 congressional testimony of Trump’s former attorney, Michael Cohen, that the Trump Organization had lied about the value of its assets in order to secure loans and insurance and to reduce its tax liability. Her focus includes the Trump Organization’s valuation of Seven Springs, a 213-acre estate in Westchester County, which it used to claim a $21.1 million tax deduction for a conservation easement on the property in 2015. James is also looking into a $160 million loan on a property at 40 Wall Street in Manhattan, which Trump personally guaranteed for $20 million, as well as “large portions of debt owed by the Trump Organization” relating to the Trump International Hotel and Tower, in Chicago, that were claimed as taxable income, and the valuation of Trump National Golf Club, in Los Angeles.
Vance’s municipal-level, criminal grand-jury investigation adds other areas of possible criminality to the scope of James’s state-level inquiry, including possible bank and tax fraud. Vance is also reportedly looking into hush money paid to Stormy Daniels and other women on Trump’s behalf—a maneuver that sent Cohen to jail for campaign-finance violations….

By law, grand juries operate in secret, but it’s publicly known that Vance has also subpoenaed Mazars USA LLP, Trump’s personal accounting firm, for financial records relating to the former president and his businesses. In July 2020, the Supreme Court rejected a bid to protect those records from disclosure on presidential-immunity grounds, and Vance finally obtained Trump’s returns in February of this year. Vance’s office has reportedly interviewed Cohen at least eight times, and Cohen has stated that: “Unfortunately for Trump, I have backed up each and every question posed by the district attorney’s office” with “documentary evidence.” Vance has also sought records from two of Trump’s largest creditors, Deutsche Bank AG and Ladder Capital Corp, and from Columbia Grammar & Preparatory School, which is attended by the grandchildren of the Trump Organization’s CEO, Allen Weisselberg, who has worked for the Trump family since 1973. In 2017, he became the only nonfamily member to serve with Trump’s sons, Eric and Don Jr., to manage the trust established to hold Donald Trump’s business assets while president.
According to the grandchildren’s mother, Jennifer Weisselberg, more than $500,000 in tuition was paid through checks signed by either Allen Weisselberg or Trump himself as part of compensation for Allen Weisselberg’s son, Barry, from 2012 to 2019. Vance’s office has been trying to get Allen Weisselberg to cooperate with the investigation.* He was also involved in reimbursing Cohen for the $130,000 payment made to Stormy Daniels before the 2016 election.
For her part, James has also subpoenaed the Trump Organization for records relating to “consulting fees” it paid to Ivanka Trump, in addition to documents regarding the various properties implicated in the investigation. In October, Eric Trump sat for a deposition by lawyers in James’s office. The Trump Foundation dissolved amid an investigation by James’s predecessor, Barbara Underwood, into whether it violated laws in connection with Donald Trump’s 2016 presidential campaign and whether its charity work was otherwise legitimate.
