We are fast approaching the day of decision: November 8, 2022 is only 3 weeks away. Democracy is on the ballot, but according to the New York Times’ interpretation of a new poll, voters aren’t that concerned about a fascist takeover by Republicans.
Voters overwhelmingly believe American democracy is under threat, but seem remarkably apathetic about that danger, with few calling it the nation’s most pressing problem, according to a New York Times/Siena College poll.
In fact, more than a third of independent voters and a smaller but noteworthy contingent of Democrats said they were open to supporting candidates who reject the legitimacy of the 2020 election, as they assigned greater urgency to their concerns about the economy than to fears about the fate of the country’s political system.
The doubts about elections that have infected American politics since the 2020 contest show every sign of persisting well into the future, the poll suggested: Twenty-eight percent of all voters, including 41 percent of Republicans, said they had little to no faith in the accuracy of this year’s midterm elections.

Fourteen percent of voters said political views revealed a lot about whether someone is a good person, while 34 percent said it revealed a little. Nearly one in five said political disagreements had hurt relationships with friends or family.

The entire article is trademark both-sidesing, of course–it’s The New York Times! The authors dug up a Democrat who is worried about “divisiveness” on “both sides.”
“I do agree that the biggest threat is survival of our democracy, but it’s the divisiveness that is creating this threat,” said Ben Johnson, 33, a filmmaker from New Orleans and a Democrat. “It feels like on both sides, people aren’t agreeing on facts anymore. We can’t meet in the middle if we can’t agree on simple facts. You’re not going to be able to move forward and continue as a country if you can’t agree on facts.”
The poll showed that voters filtered their faith in democracy through a deeply partisan lens. A majority of voters in both parties identified the opposing party as a “major threat to democracy.”
Most Republicans said the dangers included President Biden, the mainstream media, the federal government and voting by mail. Most Democrats named Donald J. Trump, while large shares of the party’s voters also said the Supreme Court and the Electoral College were threats to democracy.
Seventy-one percent of all voters said democracy was at risk — but just 7 percent identified that as the most important problem facing the country.
But why don’t we agree on “facts?” The poll suggests the media has something to do with that, but the NYT doesn’t include that in their analysis.
There was one question in the NYT poll that generated a lot of bipartisan agreement.
83% of people polled said the mainstream media is a threat to ourdemocracy.
The Times didn’t write any headlines about that though.
The polls have been so untrustworthy in the past few elections that I don’t know how much to trust them; but I do know I can’t trust the NYT to analyze the results honestly.
Meanwhile, Republicans seem so confident about taking over the House, that they are showing their cards ahead of the election.
House Minority Leader Kevin McCarthy (R-Calif.) said that if Republicans win control of the House the GOP will use raising the debt limit as leverage to force spending cuts — which could include cuts to Medicare and Social Security — and limit additional funding to Ukraine.
“You can’t just continue down the path to keep spending and adding to the debt,” the California Republican told Punchbowl News in a recent interview. “And if people want to make a debt ceiling [for a longer period of time], just like anything else, there comes a point in time where, okay, we’ll provide you more money, but you got to change your current behavior.”
“We’re not just going to keep lifting your credit card limit, right,” he added. “And we should seriously sit together and [figure out] where can we eliminate some waste? Where can we make the economy grow stronger?”
Pressed on whether changes to the entitlement programs such as Medicare and Social Security were part of the debt ceiling discussions, McCarthy said he would not “predetermine” anything.
The debt limit — the country’s borrowing cap — will need to be lifted next year to protect the country’s credit score and to prevent the United States from defaulting on its debt. But McCarthy suggested that his party would be willing to hold the debt limit up for policy changes
The debt limit is the total amount of money that the government is authorized to borrow to meet its existing legal obligations, including Social Security and Medicare benefits, military salari.es, interest on the national debt, tax refunds and other payments. The debt limit is not new spending but rather allows the government to finance existing legal obligations.
Republicans are getting ready to do Putin’s bidding if they take over the House.
Democrats and Republicans have both been backing Ukraine aid for months now. But there’s a growing sense of unease on Capitol Hill that something could soon happen to disrupt that financial support: Republicans could win the House in November.
“I’m absolutely not supporting any further funding for Ukraine,” Rep. Greg Steube (R-FL), a member of the House Foreign Affairs Committee, told The Daily Beast last week….
Throughout Congress, Republican support for providing Ukraine aid has swung in multiple directions since Russian President Vladimir Putin launched the war earlier this year. Several GOP lawmakers have told The Daily Beast they think President Joe Biden is being far too “weak” on Russia and not sending enough weapons to help Ukrainians fight back.
But there’s also been a strong and steady resistance to sending billions of dollars to Ukraine, even as Putin wages war. Some Republicans have tried to blame the war on Biden and have said they would rather focus on domestic priorities—from inflation to the southern border—and want to condition Ukraine aid on other issues, whatever the consequences may be in withholding aid from Ukraine.
Dozens of Republican members of the House have already sought to throw up roadblocks to Ukraine aid packages. Fifty-seven Republicans tried blocking $40 billion in aid to Ukraine earlier this year, in addition to 11 Republican Senators. Not a single Democrat tried to stand in the way.

In other Ukraine aid news, Elon Musk’s has threatened to stop supporting Starlink in the country. Starlink is the Musk-owned satellite system that supports internet communication in the Ukraine. He has wavered on this decision, but the Biden administration doesn’t trust him. Politico: Pentagon eyes locking in Starlink funding for Ukraine.
The Pentagon is considering paying for the Starlink satellite network — which has been a lifeline for Ukraine — from a fund that has been used to supply weapons and equipment over the long term, according to two U.S. officials who are involved in the deliberations.
The Ukraine Security Assistance Initiative is designed to provide enduring support for the Ukrainian military by financing contracts with American firms for weapons and equipment that would be delivered in months or even years….
The discussion comes after CNN reported that SpaceX warned the Pentagon last month that it would no longer be able to finance the satellite terminals and communications services, which has already cost it over $80 million and could cost hundreds of millions more over the next year….
The company donated the use of Starlink terminals after Russia invaded Ukraine in February amid fears that the country would be cut off from the outside world. SpaceX’s philanthropic efforts drew widespread plaudits.
“Putin plays the egos of big men — gives them a sense that they can play a role. But in reality, they’re just direct transmitters of messages from Vladimir Putin,” Hill told Politico this week, noting that the Tesla billionaire has tipped his hand in an obvious display of Putin’s influence.
Earlier this month, Musk tweeted a proposed peace plan he suggested could end the war in Ukraine that parroted Russian demands and echoed Kremlin talking points.

Musk also reportedly told attendees that the Kherson and Zaporizhzhia regions in Ukraine ought to be up for grabs. Russia annexed four occupied Ukrainian territories just days later, including the two mentioned by Musk.
President Joe Biden on Tuesday will promise that the first bill he’ll send to the next Congress will be legislation to reinstate the abortion protections of Roe v. Wade, according to a Democratic official previewing the president’s remarks.
In a speech at a Democratic National Committee event in Washington, Biden will also pledge to sign that bill into law around the anniversary of the original Roe ruling in late January.
Biden’s plans are contingent on Democrats holding the House and increasing their majority in the Senate, a factor acknowledged by the official previewing the remarks. As such, it is a vow that appears aimed at energizing Democrats to turn out in force in the upcoming midterm elections where the party is struggling to keep its slim majorities, as polls show early outrage over the fall of Roe v. Wade this June has been outstripped by economic concerns.
Biden has increasingly escalated his attacks on Republicans over abortion rights since the high court’s ruling this summer overturning Roe. He’s repeatedly predicted that there will be a massive surge of voter activity in the midterms pushing back against the decision — particularly from women voters. Biden also has argued that abortion will be just the start of GOP attempts to dial back rights, warning that protections for contraception and same-sex marriage could be next.
“Republicans don’t have a clue about the power of women,” he told a gathering of Democrats recently. “Let me tell you something: They’re about to find out.”

Monica had never used Reddit before. But sitting at her desk one afternoon in July — at least 10 weeks into an unwanted pregnancy in a state that had banned abortion — she didn’t know where else to turn.
“I need advice I am not prepared to have a child,” the 25-year-old wrote from her office, once everyone else had left for the day. She titled her post, “PLEASE HELP!!!!!!!!”
Within hours, she got a private message from an anonymous Reddit user. If Monica sent her address, the person promised, they would mail abortion pills “asap for free.
Monica didn’t know it at the time, but her Reddit post connected her to a new facet of the battle for abortion access: the rise of a covert, international network delivering tens of thousands of abortion pills in the wake of the Supreme Court ruling in June that struck down Roe v. Wade.
The emerging network — fueled by the widespread availability of medication abortion — has made the illegal abortions of today simpler and safer than those of the pre-Roe era, remembered for its back alleys and coat hangers. Distinct from services that sell pills to patients on the internet, a growing army of community-based distributors is reaching pregnant women through word of mouth or social media to supply pills for free — though typically without the safeguards of medical oversight.

It’s a history lesson worth taking given the fragile state of American democracy in 2022, menaced by increasingly visible far-right extremists, politicians with authoritarian tendencies, and riots in the halls of Congress. “I think it is a healthy impulse,” Maddow told me, “to look back at World War II—where the feel-good history is that all Americans were united against Hitler, and it was always inevitable that we were gonna get in the war and kick their butt—to be willing to look back at that time and the more nuanced truth of it, which is that a lot of Americans not only didn’t want us in the war, they thought if we were gonna be in the war, we should be on the other side.”
We continue to learn that there are dead-enders from every ultra-right group in American history that just raise up new generations. I was always amazed that there were still people fighting the Civil War. They’ve joined the NAZIs and other groups like White Christian Nationalists again. They found a charismatic (sic) actor in Trump, and they’re ready to go all in. The weapons that have this time are deadlier. This includes high-power guns, media of their own, and access to a worldwide web of hate and deceit.
Marjorie Taylor Greene is the stern milkmaid face of the women drawn to right-wing causes. They feel they will be rewarded for turning on women’s rights. They should’ve learned the lesson of Phyliss Schafly, who was dropped like a hot potato by the Reagan men of the right wing after she managed to tank the ERA. Marjorie has all the crassness of a Trump. She couldn’t form a more perfect opposite to Schafly, who was all about white gloves and beauty salon femininity.
We know she played a role in the insurrection. We know she continues to spew the same hateful nonsense that all the MAGA people spew. Here’s a new addition to the news on her. Fifteen hours ago, Hunter Walker wrote this on his substack: “Here Are All Of Marjorie Taylor Greene’s January 6 Text Messages With Mark Meadows.” I saw clips from her debate performance on Sunday Night. She was everything you’d expect from a MAGA performance artist. Walker begins by exclaiming she had nothing to do with the January Insurrection. But, the J6 committee may disagree. This is the moment.
I never thought I’d see anything more insane done in a debate than the one I watched where Republican Herschel Walker flashed a prop badge but there it is. She touts every conspiracy meme ever created.
In “The Breach,” a book I co-wrote with Denver Riggleman, a former Republican congressman and adviser to the committee, we detailed how Meadows’ text messages were acquired. We also described how Riggleman and other committee investigators identified the people who were texting with Meadows with a high degree of confidence. The identification of Greene was based on this work. For this story, I kept all of the original spelling and grammar as it appeared in the text log apart from changing tokens that seemed to replace apostrophes.

In April, CNN first published some of Greene’s text messages with Meadows including this exchange.
One of the messages that was first reported by CNN came from Greene on January 6 as the violence was underway. In it, she urged Meadows to have Trump “calm people.”
“Mark I was just told there is an active shooter on the first floor of the Capitol Please tell the President to calm people This isn’t the way to solve anything,” Greene wrote.
According to the log that text was sent at 2:28 pm. Trump did not make any public attempt to quell the violence until an hour and 49 minutes later.
An hour and twenty four minutes after making an appeal for calm. Greene texted Meadows a new conspiracy theory.
“Mark we don’t think these attackers are our people,” she wrote. “We think they are Antifa. Dressed like Trump supporters.”
In “The Breach,” we noted how Greene was one of several Trump allies who promoted this idea in the aftermath of the violence. There has been no credible evidence of any largescale involvement in the attack by left wing activists.
Greene repeated that idea in a lengthy message to Meadows dated the morning of January 7, 2021:
“Yesterday was a terrible day. We tried everything we could in our objection to the 6 states. I’m sorry nothing worked. I don’t think that President Trump caused the attack on the Capitol. It’s not his fault. Antifa was mixed in the crowed and instigated it, and sadly people followed. But when people try everything and no one listens and nothing works, I guess they think they have no other choice. Absolutely no excuse and I fully denounce all of it, but after shut downs all year and a stolen election, people are saying that they have no other choice. I defended Trump last night on Newsmax. He has been the greatest President. I will continue to defend him. And you if anyone attacks you. I hope you are ok. I feel badly for everyone.”
Ben Sasse is retiring from the Senate at the youthful age of 50. We know why. Politicians who thought they could wait out Trump now see the writing on the wall.

For years we watched the GOP defenestrations: Will Hurd, Jeff Flake, George W. Bush, the memory of John McCain, Paul Ryan, Liz Cheney, Adam Kinzinger, and any other Republican who stood up to Donald Trump—or even just opposed Trump’s attempted coup. Some fell on their swords. Some were tossed aside involuntarily. The result was the same.
Simultaneously, we watched the progress on the other side of the spectrum as normie Republican moderates such as Lindsey Graham, Kevin McCarthy, Elise Stefanik, Ronna Romney McDaniel, and J.D. Vance became unquestioning Trump maximalists.
What these two dynamics proved was a simple fact: In the Republican party as it is currently constituted, political power emanates completely and totally from Donald Trump.
With vanishingly few exceptions, a Republican cannot be openly opposed to Trump on any grounds—even on simple matters of fact, such as who won the 2020 election—and retain political power. Some especially skillful Republicans have managed to advance by being generally positive, but largely silent, about some aspects of Trump. But the Republicans who have advanced most are those who broadcast, in the most vehement and submissive modes possible, their total subservience—not just to the MAGA agenda, but to Trump the man. In all policies, ideas, facts, and forms.
The end result of this truth is that it has driven the Good Republican—that rare animal who was supposed to be the post-Trump future of the GOP—to near extinction.
She provides examples of DeSantis, Youngkin, and others, along with brief and toe-curling evidence. We continue to see little blowback for any actions these Republicans have taken that are immoral at best and illegal at worst. Today, the Justice Department recommended a six-month sentence for Steven Bannon’s refusal to meet his obligations when served with a congressional subpoena.

The Department of Justice asked a federal judge Monday to sentence former Trump adviser Steve Bannon to six months in prison and a fine of $200,000 for contempt of Congress.
In a 24-page sentencing memorandum filed Monday in the U.S. District Court for the District of Columbia, prosecutors called Bannon’s refusal to comply with a subpoena from the Jan. 6 committee a “sustained, bad-faith contempt of Congress.”
The House committee investigating the Jan. 6 attack on the Capitol repeatedly sought documents and testimony from Bannon but he “flouted the Committee’s authority and ignored the subpoena’s demands,” prosecutors said.
“To this day the Defendant has not produced a single document to the Committee or appeared for testimony,” they added.
Bannon is scheduled to be sentenced on Friday, exactly a year after he was held in contempt by the House.
The memo said that Bannon, who served as an adviser to former President Donald Trump, “deserves severe punishment” for his actions.
The Supreme Court on Monday declined to consider whether American Samoans have full U.S. citizenship at birth, a dispute that would have given the justices the opportunity to repudiate past rulings suffused with racist language that helped determine that those in U.S. territories would not have the same rights as other Americans.
A group of American Samoans challenging the current law, in which people from the group of islands in the Pacific Ocean are considered U.S. “nationals” at birth but not citizens, say it is a vestige of racist policies toward territories. They say that the Justice Department, in defending the law, and an appeals court, in upholding it, relied upon the so-called “Insular Cases,” a series of long-criticized early 20th century Supreme Court rulings. The Supreme Court’s decision not to hear the case means the lower court ruling remains in place.
The challenge was brought by three American Samoans who live in Utah: John Fitisemanu, Pale Tuli, and Rosavita Tuli, as well as the Southern Utah Pacific Island Coalition, an advocacy group based in Utah.
“The subordinate, inferior non-citizen National status relegates American Samoans to second-class participation in the Republic,” the challengers’ lawyers say in court papers. They note for example, that U.S. nationals cannot run for president or serve in Congress. If living in a state, they cannot vote and are barred from certain occupations.
U.S. nationals can live and work anywhere within the United States and can travel under a U.S. passport, although the challengers’ lawyers note that their passports include a statement saying “NOT A UNITED STATES CITIZEN,” which they say carries a stigma. U.S. nationals can apply for full U.S. citizenship via an expedited process.

Republicans plan to push to extend key parts of President Donald Trump’s tax cuts if they take control of Congress in this fall’s elections, aiming to force President Biden to codify trillions of dollars worth of lower taxes touted by his predecessor.
With Democrats likely to lose control of the House of Representatives and possibly the Senate, Republicans are preparing to advance legislation that would make permanent the GOP’s 2017 changes to the tax rates paid by individuals. Republican officials will also push for scrapping some of the law’s specific tax increases on corporations that were designed to offset the cost of their enormous overall cut to the corporate tax rate.
Many economists say the GOP’s plans to expand the tax cuts flies against their promises to fight inflation and reduce the federal deficit, which have emerged as central themes of their 2022 midterm campaign rhetoric. Tax cuts boost inflation just like new spending, because they increase economic demand and throw it out of balance with supply. But Republicans say they believe these efforts would put Biden in a political bind, requiring him to choose between vetoing the tax cuts — giving the GOP an attack line in the 2024 presidential election — or allowing Republicans to win on one of their central legislative agenda items.
Former president Donald Trump’s company charged the Secret Service as much as five times more than the government rate for agents to stay overnight at Trump hotels while protecting him and his family, according to expense records newly obtained by Congress.
The records show that in 40 cases the Trump Organization billed the Secret Service far higher amounts than the approved government rate — in one case charging agents $1,185 a night to stay at the Trump International Hotel in D.C. The new billing documents, according to a congressional committee’s review, show that U.S. taxpayers paid the president’s company at least $1.4 million for Secret Service agents’ stays at Trump properties for his and his family’s protection.
“The exorbitant rates charged to the Secret Service and agents’ frequent stays at Trump-owned properties raise significant concerns about the former President’s self-dealing and may have resulted in a taxpayer-funded windfall for former President Trump’s struggling businesses,” Rep. Carolyn B. Maloney (D-N.Y.) wrote to Secret Service Director Kimberly Cheatle.
Former N.J Governor Chris Christie has broken from the Trump Circle He said this in an ABC interview as reported by The Hill.
“I think it’s much more likely they’re a trophy that he walks around and says, ‘Look, I’ve got this. I’ve got this classified document or that,’ because remember something, he can’t believe he’s not president,” Christie said.
“He can’t believe he still doesn’t get these documents, and he needs to display to everybody down at Mar-a-Lago or up in Bedminster during the summer he still has some of those trappings. The replica Resolute Desk in Mar-a-Lago and all the rest of those things are things that are assuaging, you know, his disappointment and his disbelief that he’s not the president anymore.”
The more I read and see, the more I realize that the Republicans and their elected officials are anything but a political party. The path was charted when Ronald Reagan said this at his inaugural address.
“Government is not the solution to our problem, government is the problem.”
Anyone with that attitude should not be in political office. They should be in jail with all those MAGAs supporting a violent insurrection against the United States of America. They should be there for life.

We are living in perilous times. Thanks to Trump’s enabling of U.S. Neo-Nazis, we’re learning that these toxic groups are everywhere–even here in ultra-blue Massachusetts. Back in July, about 100 members of a white supremacist group called Patriot Front marched through downtown Boston in matching outfits, their faces concealed by masks. It was quite a shock to local law enforcement and city leaders.
Internal videos released this year by a nonprofit media groupshowed Patriot Front members in action—boxing in the woods in Sutton, spray-painting graffiti in Quincy, draping their banner from a Storrow Drive overpass in Boston, slapping on stickers in Providence’s Waterplace Park.
Despite New England’s reputation as a deeply blue region, those who’ve studied Patriot Front say that its local faction is among the group’s most active nationally, along with Virginia and Texas, where several of its leaders are based. The group, rooted in a notorious far-right rally in Virginia in 2017, is finding a receptive audience for its white supremacist ideology among certain young men — and has targeted colleges for recruitment.
In fact, there have been hundreds of incidents involving Patriot Front members in Massachusetts and Rhode Island this year alone, according to statistics compiled by the Anti-Defamation League. In addition, at least ninePatriot Front members or associates from across the region have faced charges stemming from their work for the group.
“These extremists perceive New England to have favorable racial demographics, which supposedly presents more opportunities to find like-minded people,”said Jeff Tischauser, a senior research analyst with the Southern Poverty Law Center, in an e-mail. “Extremists around the U.S. also take inspiration from New England history before, during, and immediately after the American Revolution.”
The July 2 march in Boston, which caught law enforcement and much of the public by surprise, represented something of a coming out party for the organization in New England, drawing members from all over the country to the city’s streets on a bustling holiday weekend. The noisy march of young white men banging drums and hoisting Patriot Front flags along the city’s storied Freedom Trail made national headlines and drew a sharp rebuke from Mayor Michelle Wu.
So I guess it shouldn’t be that surprising to learn that a police officer in Woburn, Massachusetts is a Neo-Nazi with ties to white supremacist leader Richard Spencer. Somehow John Donnelly was able to keep it a secret until he was smoked out by an anti-fascist group called Ignite the Right. Here’s the beginning of Twitter thread they posted. A Massachusetts police officer attended the deadly “Unite the Right” rally in Charlottesville, Virginia, five years ago and acted in key security and planning roles, HuffPost has confirmed. He also used an alias to post racist and antisemitic comments online. The officer, John Donnelly, was still an active-duty member of the police force until Thursday, shortly after HuffPost inquired about his status with the department and role in the deadly white supremacist rally.
Donnelly, 33, was a patrolman for the Woburn Police Department near Boston, where he has been employed since 2015.
But on the morning of Aug. 12, 2017, Donnelly could be seen on video arriving at the Charlottesville rally with Richard Spencer, a prominent white supremacist for whom Donnelly was apparently acting as a security guard. Spencer, Donnelly and a coterie of other suit-and-tie fascists worked their way into a city park where they held court beneath a statue of Confederate Gen. Robert E. Lee, posing for photos and talking into livestreams.
Donnelly was among hundreds of white supremacists who invaded the university town. His fellow attendees violently attacked counterprotesters, with one neo-Nazi driving his car into a crowd of anti-fascists, killing a 32-year-old woman and injuring 19 others. That evening, Donnelly went to a party at a house near Charlottesville, where he joined in a celebration of the day’s events.
Donnelly then returned to Massachusetts and resumed his job as a cop.
His white supremacist activism and involvement in the Charlottesville rally has gone unknown for five years, during which time Donnelly — while still working as a police officer — became the president of a “back the blue” nonprofit raising money for law enforcement, as well as an award-winning real estate agent whose face is featured on a massive billboard in Woburn, a Boston suburb.
But last month, an anti-fascist collective called Ignite the Right provided HuffPost with evidence showing Donnelly attended the Charlottesville rally and connecting him to a series of deeply alarming messages posted online in which he advocated violence against leftists and minority groups.

A Massachusetts prosecutor has promised to review all cases handled by police Officer John Donnelly after a HuffPost report exposed Donnelly’s role in planning the deadly 2017 white supremacist rally in Charlottesville, Virginia.
Middlesex County District Attorney Marina Ryan announced Friday that her office is now “thoroughly reviewing any pending or closed cases” in which Donnelly, a patrolman in Woburn, Massachusetts, was involved.
“We will be issuing a discovering notice disclosing this matter to defense counsel on those cases,” Ryan said in a statement. “That notice has already been added to our publicly available list of officers subject to exculpatory evidence disclosure.” [….]
On Thursday, HuffPost published a report detailing how Donnelly, 33, was among hundreds of white supremacists who descended on Charlottesville in August 2017 for a “Unite the Right” rally, terrorizing the town while chanting slogans such as “Jews will not replace us” and violently attacking counterprotesters….
Donnelly attended the rally as a bodyguard for Richard Spencer, a prominent white supremacist. Leaked chat logs from a neo-Nazi Discord server show Donnelly played an integral part in planning the weekend’s events.
The messages Donnelly posted on Discord show he may have belonged to the white supremacist group Identity Evropa. His messages were also full of racist and antisemitic slurs, and at times they advocated violence against leftists and minorities.
I usually don’t share local stories, but this is likely the tip of the iceberg. There are very likely many more police officers like Donnelly everywhere in the U.S. I suppose they were always there, but Trump has enabled them and given them permission to act out.

In a sealed decision that could clear the way for other top Trump White House officials to answer questions before a grand jury, Chief U.S. District Judge Beryl A. Howell ruled that former Pence chief of staff Marc Short probably possessed information important to the Justice Department’s criminal investigation of the Jan. 6, 2021, attack on the Capitol that was not available from other sources, one of those people said.

Trump appealed, but the U.S. Court of Appeals for the District of Columbia Circuit refused to postpone Short’s appearance while the litigation continues, the people said, signaling that attempts by Trump to invoke executive privilege to preserve the confidentiality of presidential decision-making were not likely to prevail….
Grand jury matters are typically secret, but The Washington Post has reported that prosecutors are working with grand jurors and looking extensively at the actions of Trump and his advisers in the period between the November 2020 election and Jan. 6, 2021. Short’s case came to light on Sept. 22 after Trump attorneys M. Evan Corcoran, Timothy C. Parlatore and Rowley were seen at federal court in Washington when there were no publicly scheduled matters, along with a lead Jan. 6 federal prosecutor, Thomas Windom.
According to people familiar with the matter, Short had appeared before a grand jury in downtown Washington in July, but declined to answer certain questions after Flood argued the communications of top White House advisers are protected — and presented written documentation from Trump’s lawyers that they were asserting executive privilege.
The Justice Department asked the court to intervene, urging Howell to override Trump’s claim and to compel Short to answer questions about his communications with Trump, one person said. After arguments Sept. 22, Howell granted the government’s motion, the people said, but because the investigation and an appeal are ongoing, it is unclear if or when a redacted opinion will become public.
The House Committee investigating the Jan. 6, 2021, Capitol insurrection has asked the Secret Service for records of all communications between the far-right Oath Keepers group and Secret Service agents prior to and on the day of the attack, after a preliminary accounting by the agency indicated multiple contacts in 2020, according to a Secret Service spokesman.
The spokesman said the Congressional request follows a short telephonic briefing from the Secret Service to committee staff, in which the agency said an agent from its protective intelligence division had “numerous” contacts with Oath Keepers leader Stewart Rhodes and other group members prior to Trump rallies in fall 2020, but that they were all part of common practice to inform the group of security protocols to follow.
That initial briefing was prompted by federal trial testimony in which the ex-leader of the North Carolina Oath Keepers said Rhodes was in contact with a member of the Secret Service around the time of a September 2020 rally….

The Secret Service found that multiple members of the organization, not just Rhodes, spoke to an agent in the protective intelligence division ahead of Trump rallies, the most recent conversation coming before a Dec. 12, 2020, rally, Guglielmi said.
Guglielmi also said the initial search showed the communications were part of common practices that allow agents to tell protesters where they can and cannot be during an event and what items they are prohibited from bringing.
“They reached out concerning logistics about demonstration areas and rules for attending presidential events. This is common activity between organized groups and advance agents,” said Guglielmi.
Two Secret Service officials told NBC News once the Oath Keepers had the phone number of the member of the agency’s protective intelligence detail, they made numerous calls directly to that agent.
Maybe it was routine, maybe not. I’m taking everything the Secret Service says with a grain of salt.
In a 53-page brief for the U.S. Court of Appeals for the 11th Circuit, in Atlanta, the Justice Department broadly challenged the legal legitimacy of orders last month by Judge Aileen M. Cannon, who blocked investigators from using the materials and appointed an independent arbiter to sift them for any that are potentially privileged or Mr. Trump’s personal property.
The Justice Department already succeeded in persuading a panel of the Atlanta-based court to exempt about 100 documents marked classified from Judge Cannon’s move — a decision the Supreme Court declined to overturn this week. In its new filing, the Justice Department asked the appeals court to reverse her order for the remaining 11,000 or so records.
“This court has already granted the government’s motion to stay that unprecedented order insofar as it relates to the documents bearing classification markings,” the filing said. “The court should now reverse the order in its entirety for multiple independent reasons.” [….]
The Trump legal team is due to file a brief in November. The date of any oral arguments has not yet been announced, but the appeals court has granted a Justice Department request that it expedite consideration of the case. It may rule on the appeal before Judge Cannon receives the special master’s report and rules on any contested documents.
The dispute is the opening round in the main part of the Justice Department’s appeal of the orders by Judge Cannon as part of a lawsuit Mr. Trump filed after the F.B.I. carried out a court-ordered search of his Florida club and residence, Mar-a-Lago, in August.
Federal investigators contacted at least two aides to former President Donald Trump months before the FBI searched his Mar-a-Lago resort and have sought to talk to them again in recent weeks, people familiar with the matter said, as the Justice Department examines possible obstruction of its efforts to retrieve hundreds of government and classified documents.

The aides, Walt Nauta and Will Russell, are witnesses in the Justice Department’s investigation into the handling of presidential and classified records taken from the White House but aren’t formally cooperating with the probe, the people said. Mr. Russell hasn’t personally spoken to investigators, who are communicating directly with his counsel.
Mr. Nauta, a former military valet who went to work at Mar-a-Lago after Mr. Trump left the White House, was seen on surveillance footage moving boxes from a storage room before and after investigators issued a subpoena in May seeking the documents’ return, the people said. Mr. Nauta told investigators that he did so at Mr. Trump’s request, one of the people said.
The federal interest in Mr. Russell hasn’t been previously reported. He served in the Trump White House, including as a coordinator of presidential travel, and went on to work for the former president in Florida after he left office. Mr. Russell had previously been subpoenaed in connection with the Justice Department’s investigation of the Jan. 6, 2021, riot at the U.S. Capitol. The Wall Street Journal previously reported that the extraordinary Aug. 8 search came after at least one person familiar with the stored papers told investigators there were more sensitive documents at Mar-a-Lago beyond what they had received in June through a grand jury subpoena.
Those two had better watch their backs. Now that their names are out there they’ll likely be dealing with death threats from the Trump cult.
I admit to needing my support dog Temple and her support Kitty Kristal to get through the last of the January 6 Committee’s hearings. Cassiday Hutchinson’s testimony continues to frame the narrative of how Trump planned and carried out his attempted insurrection. Over 30 of Trump’s cronies testified simply by exercising their fifth amendment right. That was one of two clips that really was irritating. The second was a series of statements made by Trump that made his weird cadence so obvious it hurt my ears worse than country music. The scene stealer for the day was Leader Pelosi, whose daughter was filming a documentary and captured the senate and house leadership in their hidey-hole at Fort McNair.
BB pointed out the presence of Republican Louisiana Congressman Steve “Sleazy” Scalise because I was so fixated on watching Senate Minority Leader McConnell’s expression. It’s significant for several reasons. First, he was standing behind McConnell while Leader Pelosi was trying to figure out how to get the Virginian and Maryland National Guard to the Capitol. You could tell it was early in the insurrection because as she spoke to the Governor of Virginia, you could see the mob breaking windows to surge into the Capitol building on a TV screen in the room.
The second reason it’s very important is that Scalise and other Republicans insisted that Pelosi tried to slow down the call to get the Guard a little over a year later. At the same time, we know the only person ignoring that duty was Trump himself.
Steve Scalise had the unmitigated gall to blame Speaker Pelosi for a delayed response in getting the National Guard on January 6th, even though he stood inches away from her as she called the DoD, the DOJ, and numerous states to save HIM and others.

Today’s Republicans are genuinely unable to speak the truth. Senator Liz Cheney of Wyoming is now telling everyone who will listen to vote a straight Democratic ticket rather than lose our democracy. She didn’t make it through the republican congressional primary in Wyoming. Cheney and Adam Kinzinger will be out of Congress after the elections. Kinzinger and Cheney will no longer be able to sit on the Committee should it continue after the elections.
It was essentially two-and-a-half hours of leadup to the final moment of the Jan. 6 hearing. Donald Trump, in the words of Vice Chair Liz Cheney, had a “premeditated plan to declare the election was fraudulent and stolen before Election Day”; he knew he had lost and fed his base endless lies about it; he welcomed a siege of the Capitol and did nothing to stop it. And because, in Cheney’s words, the “cause of Jan. 6th was one man… his state of mind, his intent, his motivations…,” his testimony was required.
With that, the committee unanimously voted to subpoena the former president, ensuring the day’s headline news.
It is almost surely a symbolic act. The odds that Trump will enthusiastically appear to make his case is roughly equivalent to Herschel Walker’s admittance into Mensa, and the committee’s writ will expire by year’s end, long before a court fight over the subpoena would be resolved. While it may make for full employment for cable news legal experts, it also has the potential to overshadow the most striking revelations from today’s hearing — that the Secret Service had days of advance knowledge about the potential for violence at the Capitol, as well as the steely resolve of Speaker Nancy Pelosi, who reached out for help in combatting the violence as it was happening. (Her conduct also makes a strong case that age is not necessarily a disabling quality in a leader.)
I still believe the actions of Nancy Pelosi were a big deal in the hearing presentation. This is especially true given the events unfolding around her. It truly should put down the old adage that women do not have the “steely resolve” to be leaders under pressure.
Still, the unsigned SCOTUS decision is likely a bigger blow to Trump in the long run.
… the U.S. Supreme Court turned down Trump’s request to allow a special master in the Mar-a-Lago case to review classified documents. The unsigned order involved a relatively narrow dispute, but the lack of any dissents suggests that the court may not give Trump the protection he will seek from the Justice Department, should it end up indicting Trump for violating one or more federal laws. For all of the legal landmines in Trump’s path — breaking Georgia’s laws on election interference, a possible contempt citation if he refuses to comply with today’s subpoena — the Mar-a-Lago case remains the most damaging to Trump, especially considering that at different times, he has more or less acknowledged breaking one or more of the laws regarding federal documents.
The Republicans are trying to make hay with the bad news on inflation. This inflation is due to the Saudi manipulation of the oil market and the Putin invasion of Ukraine. The worst inflation resides in the core elements of oil, gas, and food. This is a worldwide problem, meaning none came from us or any policy. This was the third thing that Greenfield spoke to if you’re interested.
I was in Greece recently. Inflation there is over 10% and gas was over $8/gal. I asked several people what caused it. They all responded COVID and the war in Ukraine. No one mentioned Joe Biden or any Democratic members of Congress
Meanwhile, Trump only appears to have one condition to testify before the Committee. This is via The Daily Beast’s Zachary Petrizzo.
After the Jan. 6 committee unanimously voted in favor of subpoenaing former President Donald Trump, he’s been telling those in his orbit he’s not opposed to the idea. “The former president has been telling aides he favors doing so, so long as he gets to do so live, according to a person familiar with his discussions,” The New York Times’ Maggie Haberman reported on Thursday evening. “However, it is unclear whether the committee would accept such a demand.” Not everyone in Trump’s circle is convinced that him testifying would be a wise idea, however. “He should not,” a Trump adviser who speaks regularly with the former president told The Daily Beast on Thursday evening. A Trump spokesperson didn’t immediately return The Daily Beast’s request for comment. Taking to Truth Social, Trump said he will share his response to the subpoena Friday morning, while claiming the committee is “a giant scam, presided over by a group of Radical Left losers, and two failed Republicans.”
Former President Trump on Thursday dismissed a House committee’s vote to subpoena him for testimony about the events of Jan. 6, 2021, as a publicity stunt.
“Why didn’t the Unselect Committee ask me to testify months ago?” Trump posted on Truth Social shortly after the House panel investigating the Capitol riots on Jan. 6 voted to subpoena him.
“Why did they wait until the very end, the final moments of their last meeting? Because the Committee is a total ‘BUST’ that has only served to further divide our Country which, by the way, is doing very badly – A laughing stock all over the World?” Trump continued.

A week after the Jan. 6 attack, an email landed in a top FBI official’s inbox expressing concern that some bureau employees might not be particularly motivated to help bring to justice the rioters who stormed the U.S. Capitol and threatened lawmakers’ lives.
“There’s no good way to say it, so I’ll just be direct: from my first-hand and second-hand information from conversations since January 6th there is, at best, a sizable percentage of the employee population that felt sympathetic to the group that stormed the Capitol,” and that it was no different than the Black Lives Matter protests of the summer of 2020, the person wrote in an email to Paul Abbate, who is now the No. 2 official at the bureau. “Several also lamented that the only reason this violent activity is getting more attention is because of ‘political correctness.’”
The email, recently disclosed publicly in response to a Freedom of Information Act request, reflects an issue that’s been hanging over the Jan. 6 investigation since it began: the notion that there are some in the bureau who weren’t, and aren’t, particularly driven to bring cases against the Capitol rioters.
The content of the full email, which includes a reference to “my first unit,” coupled with the fact that Abbate replied suggests that the sender, whose name is redacted, was likely someone plugged into the bureau or a former agent. The email was labeled external, indicating it was not sent from an active bureau account.
“I literally had to explain to an agent from a ‘blue state’ office the difference between opportunists burning and looting during protests that stemmed legitimate grievance to police brutality vs. an insurgent mob whose purpose was to prevent the execution of democratic processes at the behest of a sitting president,” the person wrote to Abbate. “One is a smattering of criminals, the other is an organized group of domestic terrorists.”
The person also wrote that an official in one FBI office in a “red state” said that more than 70% of that office’s counterterrorism squad and about three-quarters of its agent population disagreed with the violence, “but could understand where the frustration was coming from.”
In his response, Abbate wrote: “Thank you [redacted] for sharing everything below.”

The Secret Service has too many secrets. The Federal Bureau of Investigation requires a thorough investigation.
These are among the most striking conclusions that emerged Thursday from the last public meeting of Congress’s Jan. 6 committee. Laying out its meticulously crafted case against former President Donald Trump for leading an insurrection against the government he had sworn an oath to protect, the committee made it clear that there were many targets that warranted further investigation. Not least of these were the two law enforcement agencies that had long prided themselves on being among the U.S. government’s most shining examples of integrity and service.

The real culmination of the inquiry must be left to the Sphinx-like Department of Justice, whose silence might reveal its commitment to the secrecy that should surround an historically significant investigation. Or that silence might be followed by inaction. We just cannot know at this point, even though the Jan. 6 committee’s revelations made it clear that inaction in the face of the evidence that exists would be one of the greatest miscarriages of justice in U.S. history and would set a dangerous precedent, leaving our entire system at risk.
But there were other disturbing threads that emerged from the congressional inquiry that themselves appeared to require their own independent inquiry. Several of these concern the seeming existence of what might be called the “dark state.” This is not the conspiracy theory fantasy spun by the far right about a “deep state” permanent government that was foiling the will of the people: That was always such a stalking horse, a concept that would enable MAGA officials to root out public servants who placed fealty to the Constitution ahead of loyalty to a political party. Rather it was a real loose alliance among Trump allies in the government who were willing to set aside the rule of law in the service of Trump himself.
At the core of this movement were officials within key government agencies—including the Department of Homeland Security and within it the Secret Service, the FBI, the Department of Defense, the Department of Justice and the intelligence community—who had been placed in positions of responsibility because they could be counted upon to bend the rules for Trump.

The probable final January 6 Committee Hearing will be held today at 1PM. I hope it will be a blockbuster. I’m disappointed that the committee hasn’t held more televised hearings. I know there will be a final report, but how many people will actually read it? At least we now know that Merrick Garland is actively pursuing investigations of Trump and his crimes. The stolen documents case could more easily lead to an indictment than the case against Trump for inciting the insurrection.

The House committee investigating the Jan. 6 attack is planning on Thursday to present a sweeping summation of its case against former President Donald J. Trump at what could be its final public hearing, seeking to reveal damning new evidence about Mr. Trump’s state of mind and his central role in the effort to overturn the 2020 election.
Armed with new witness interviews and unreleased footage of the violence of Jan. 6, 2021, the panel is planning to argue that Mr. Trump’s lies about widespread voter fraud inspired far-right extremists and election deniers who present a continuing threat to American democracy.
Unlike previous hearings, which focused on specific aspects of Mr. Trump’s attempts to overturn the election, members will attempt to portray the entire arc of the plan, demonstrating Mr. Trump’s involvement in every step — even before Election Day.
The hearing comes at a pivotal moment, weeks before midterm elections in which control of Congress is at stake and as time is running out for the panel to complete its work, including an extensive report on its findings. Should Republicans succeed in their drive to win the House majority, they would be all but certain to disband the committee in January and shut down any official accounting by Congress for the largest attack on the Capitol in centuries.

To bolster its case, the committee has obtained more than 1.5 million pages of documents and communications from the Secret Service that include details of how agents blocked Mr. Trump’s attempts to join his supporters at the Capitol even after they had begun the assault.
The communications lay out how Secret Service personnel attempted to find a route to take Mr. Trump to the Capitol in a presidential S.U.V., and how those plans were ultimately rebuffed amid the chaos.
Secret Service staff initially attempted to accommodate Mr. Trump’s wishes, but supervisors at the agency expressed alarm, and District of Columbia police declined to block off intersections for his motorcade as a mob of his supporters began attacking and injuring dozens of police officers, according to the communications, which were described by two people familiar with their contents.
Robert Engel, Mr. Trump’s lead agent, broke the news to Mr. Trump inside the vehicle, prompting an angry outburst. Afterward, a Secret Service supervisor followed up to ensure Mr. Trump would not be joining the mob at the Capitol, the communications show.
The likely final public hearing of the House committee investigating the Jan. 6, 2021, attack on the U.S. Capitol is expected to highlight newly obtained Secret Service records showinghow President Donald Trump was repeatedly alerted to brewing violence that day, and he still sought to stoke the conflict, according to three people briefed on the records.
During Thursday’s hearing, the committee plans to share new video footage and internal Secret Service emails that appear to corroborate parts of the most startling inside accounts of that day, said the people briefed, who, like others who spoke to The Washington Post, spoke on the condition of anonymity to discuss sensitive records and conversations. Former White House aide Cassidy Hutchinson testified in June that Trump was briefed on Jan. 6 that some of his supporters were armed for battle, demanded they be allowed into his rally and insisted he wanted to lead them on their march to the Capitol.
Surveillance footage the committee plans to share was taken near the Ellipse that morning before Trump’s speech and shows throngs of his supporters clustered just outside the corralled area for his “Stop the Steal” rally. Secret Service officers screened those entering who sought to get closer to the stage. Law enforcement officials who were monitoring video that morning spotted Trump supporters with plastic shields, bulletproof vests and other paramilitary gear, and some in the Secret Service concluded they stayed outside the rally area to avoid having their weapons confiscated, according to people familiar with the new records.
Other internal emails likely to be revealed at the hearing further buttress accounts about staff members warning Trump about the risk and then the reality of violence that day, as he continued to press nervous Secret Service agents to take him to the Capitol to join his supporters marching there, the three people said. After being alerted to violence erupting at the Capitol when he returned to the White House, Trump tweeted criticism of Vice President Mike Pence for not blocking the certification of the election, whipping up supporters who had already trampled over security barricades and were battling police to break into the halls of Congress.
The newly obtained Secret Service records are just part of a larger hearing in which the committee hopes to summarize and remind the American public of all the ways Trump is said to have played a central role in fomenting a violent insurrection at the Capitol, one of the most brutal attacks on democracy in U.S. history, according to multiple people briefed on the evidence and committee plan.

Donald Trump’s bid to subvert the 2020 election didn’t end on Jan. 6, 2021, or even when he left office. Since then he’s gone to even further lengths to delegitimize his defeat.
That ongoing effort will be a centerpiece of the Jan. 6 select committee’s next — and perhaps final — televised pitch to Americans on Thursday.
“Tune in for our discussion of Trump’s clear and present danger presented to democracy and freedom in America by a movement that he’s galvanized,” panel member Rep. Jamie Raskin (D-Md.) said this week at a virtual People for the American Way event.
The panel intends to focus on evidence that Trump has “consistently and increasingly” been using rhetoric “that we knew caused violence on Jan. 6,” Rep. Liz Cheney (R-Wyo.) told reporters recently. Cheney cited recent comments by U.S. District Court Judge Amy Berman Jackson in which she upbraided elected Republicans for continuing to indulge “one man, who knows full well that he lost, instead of the Constitution he was trying to subvert.”
The select committee’s closing pitch to Americans will draw on all aspects of its more than yearlong probe. It’s expected to feature evidence that Trump’s allies were pushing him to declare victory on Election Day 2020 even before the votes were counted, and that Trump was warned of the unfolding violence at the Capitol before he tweeted an inflammatory attack on then Vice President Mike Pence.
By contending that even amid the wreckage of Jan. 6, Trump continued to plot ways to remain in power, the hearing will also function as a segue of sorts to the criminal case that federal prosecutors are piecing together — bolstered by the recent issuance of dozens of grand jury subpoenas and court-authorized searches of some of Trump’s top allies.
The committee has long emphasized its distinct mission from prosecutors — to inform the public and develop legislative recommendations to prevent future attacks on the peaceful transfer of power — but has used its platform to press the Justice Department to pursue potential crimes among Trump’s inner circle.

After Trump advisers received a subpoena in May for any classified documents at Mar-a-Lago, Trump told people to move boxes to his residence at the property.
A Trump employee has told federal agents about moving boxes of documents at Mar-a-Lago at the specific direction of the former president, according to people familiar with the investigation, who say the witness account — combined with security-camera footage — offers key evidence of Donald Trump’s behavior as investigators sought the return of classified material.
The witness description and footage described to The Washington Post offer the most direct account to date of Trump’s actions and instructions leading up to the FBI’s Aug. 8 search of the Florida residence and private club, in which agents were looking for evidence ofpotential crimes including obstruction, destruction of government records or mishandling classified information.
The people familiar with the investigation said agents have gathered witness accounts indicatingthat, after Trump advisers received a subpoena in May for any classified documents that remained at Mar-a-Lago, Trump told people to move boxes to his residence at the property. The employee who was working at Mar-a-Lago is cooperating with the Justice Department and has been interviewed multiple times by federal agents, according to the people familiar with the situation, who declined to identify the worker.
In the first interview, these people said, the witness denied handling sensitive documents or the boxes that might contain such documents. As they gathered evidence, agents decided to re-interview the witness, and the witness’s story changed dramatically, these people said. In the second interview, the witness described moving boxes at Trump’s request.
The witness is now considered a key part of the Mar-a-Lago investigation, these people said, offering details about the former president’s alleged actions and instructions to subordinates that could have been an attempt to thwart federal officials’ demands for the return of classified and government documents.

A long-serving aide to former President Donald J. Trump was captured on security camera footage moving boxes out of a storage room at Mar-a-Lago, Mr. Trump’s residence in Florida, both before and after the Justice Department issued a subpoena in May demanding the return of all classified documents, according to three people familiar with the matter.
The footage showed Walt Nauta, a former military aide who left the White House and then went to work for Mr. Trump at Mar-a-Lago, moving boxes from a storage room that became a focus of the Justice Department’s investigation, according to the people briefed on the matter. The inquiry has centered on whether Mr. Trump improperly kept national security records after he left the White House and obstructed the government’s repeated efforts to get them back.
As part of its investigation, the Justice Department has interviewed Mr. Nauta on several occasions, according to one of the people. Those interviews started before the F.B.I. executed a search warrant at Mar-a-Lago on Aug. 8 and carted off more than 11,000 documents, including about 100 that bore classification markings. Mr. Nauta has answered questions but is not formally cooperating with the investigation of Mr. Trump’s handling of the documents….
A top Justice Department official told Mr. Trump’s lawyers in recent weeks that the department believed he had still not returned all the documents. It is unclear if the boxes that were moved were among the material later retrieved by the F.B.I.
The National Archives, the federal agency that oversees presidential records, spent much of 2021 attempting to retrieve boxes of records that its officials had been told were in the White House residence at the end of the Trump presidency.

DONALD TRUMP IN the final days of his presidency repeatedly threatened to out government sources involved in the Trump-Russia investigation, an anti-Deep State revenge fantasy he still obsesses over to this day, according to two former senior Trump aides and another person familiar with the matter.
One of these sources tells Rolling Stone that in the days after the Jan. 6 Capitol riot, the then-president, sometimes while brandishing pieces of paper, would loudly complain that none of the identifying facts in the highly sensitive Russia documents should be blacked-out. Trump would insist, the source says, that it should “all be out there” so that the American people could see the truth of who “did it” to the president.
Ultimately, top intelligence officials and other Trump lieutenants talked him out of publicizing the sources’ identities before he left the White House, the sources say. Instead, Trump’s team bargained him down to vetting a series of heavily redacted reports that they argued would help safeguard the work and safety of Russia-related informants.
But a third source familiar with the situation says that this obsession with outing the confidential sources is ongoing. The former president, the source says, still sporadically talks about the need to get “the names” out into the public record. A Trump spokesperson did not immediately respond to Rolling Stone’s request for comment.
As Trump faces accusations that he hoarded sensitive classified documents at his private residence in Florida, the last-minute battle over redactions highlights how his disregard for security concerns at times has even rattled aides close to him.
Trump’s threats to out sources were part of a broader push during the chaotic end of his presidency. In December of 2020, as the odds against a successful overturning of the election grew longer, Trump and his chief of staff Mark Meadows pushed the Justice Department to declassify a binder full of records related to the FBI’s 2016 Russia investigation. In his memoir, Meadows described himself in the final hours of the Trump presidency going line by line through the “notes, memos and emails” in the binder to ensure it “would not inadvertently disclose sources and methods.”

With hours left before President Joe Biden took office in Jan. 2021, the White House sent a presidential memo to the Director of National Intelligence, CIA director, and acting Attorney General. The memo ordering the declassification of the binder references concern from the FBI, which stated its “continuing objection to any further declassification” of the binder on the grounds that specific passages “included Intelligence Community equities.” In an apparent nod to the efforts to walk the then-president back from outing “the names,” the memo says his declassification order “does not require the disclosure of certain personally identifiable information.”
The order also exempts from declassification any material that “must be protected from disclosure pursuant to orders of the Foreign Intelligence Surveillance Court,” according to the memo.
At the same time, Trump gave conservative reporter John Solomon access to some of the documents. In a statement to Rolling Stone, Solomon says that on January 19, 2021, Trump allowed him “on two occasions, to briefly review a stack of documents that I was told were the declassified documents” and that he received “a small subset of the declassified documents” from the Justice Department in the mail at the time.
