    Rape victim can sue after being arrested and denied contraception.

    The victim, who is only identified as R.W. in court records, visited Tampa’s Rape Crisis Center on Jan. 27, 2007 where a “rape kit” procedure was performed and she was given two contraception pills. The doctor instructed her to take one pill immediately and the second one 12 hours later.

    R.W. then reported her rape to Tampa police and was arrested after it was discovered she was wanted for failure to appear and failure to pay restitution on a previous charge.

    When R.W. requested her second contraception pill the next morning, Hillsborough County Jail employee Michele Spinelli refused on religious grounds.

    “Spinelli told the Plaintiff that she would not give R.W. the pill because it was against Spinelli’s religious beliefs,” a complaint (PDF) filed in United States District Court Tampa Division states.

      Yes … violating some one else’s religious views because of yours should be actionable!

    • These stories about “religious beliefs” are really pissing me off.

      All the moves and excuses to force the right’s beliefs on everyone should be seen in a historical perspective. After seeing women used in so many historic items of propaganda while at those history museums in DC it makes me want to scream. You know, Hitler was in every woman’s uterus too…I know it is an extreme leap…but I am just saying.

        No that isn’t a leap at all.

        Totalitarian governments and churches will do what ever it takes to control women — this seems to be a patriarchal thing. Hitler’s Germany — the Fatherland.

        Isn’t it ironic – a woman gets raped and then put in jail where the probability is high that she will be assaulted while in jail. And she was assaulted — but a religious nutjob.
